REASONS:


The opponent filed an opposition against some of the goods and services of European Union trade mark application No 12 714 218, namely against some of the goods and services in Classes 3, 8, 9, 11, 14, 16, 18, 20, 21, 24, 25 and 35. The opposition is based on European Union trade mark registration No 12 710 091. The opponent invoked Article 8(1)(a) and (b) EUTMR.

Since the Opposition Division cannot dissect ex officio the broad category of the applicants goods, they are considered identical.


The contested Clothes-pins refer to the same goods as the earlier Clothes-pegs and are therefore identical.


The contested Drying racks for laundry refer to the same goods as the earlier Clothes drying hangers and are therefore identical.

They do not share the same commercial origin, nor the distribution channels and are also not directed at the same consumers.




  1. Relevant public — degree of attention


The average consumer of the category of products concerned is deemed to be reasonably well informed and reasonably observant and circumspect. It should also be borne in mind that the average consumer’s degree of attention is likely to vary according to the category of goods or services in question.


In the present case, the goods and services found to be identical or similar are directed at the public at large as well as at business customers with specific professional knowledge or expertise. The degree of attention may vary from average to high.

The relevant territory is the European Union.


The global appreciation of the visual, aural or conceptual similarity of the marks in question must be based on the overall impression given by the marks, bearing in mind, in particular, their distinctive and dominant components (11/11/1997, C‑251/95, Sabèl, EU:C:1997:528, § 23).


The earlier mark is a figurative mark composed of the verbal element ’SHAIK’ in big bold stylised letters in the centre of the mark and the further verbal elements ‘DESIGNER SHAIK’ placed below the central verbal element. On top of the verbal elements there are Arabic letters and an unrecognisable figurative element with three pointed decorations. Further, there is a representation of a woman in a seal to the right of the letter “A” within the verbal element ‘SHAIK’.


The contested sign is a figurative mark composed of the verbal element ‘SHAIK’ in big white letters and above a circle which contains a logo which some would recognise as containing the letter ‘S’ and some further unrecognisable figurative elements as well as a central horizontal line.


The contested mark has no elements that could be considered clearly more distinctive than other elements.


The element ‘DESIGNER’ of the earlier sign will be associated with ‘A person who makes artistic designs’ (www.oed.com) throughout the Union as it is commonly used with fashion and cosmetics goods. Bearing in mind that the relevant goods and services could be designed by a designer or relate to the retail of designer goods, it is considered that this element is non-distinctive for all the earlier goods and services.


The contested mark has no element that could be considered more dominant (visually eye-catching) than other elements.


The element ‘SHAIK’ in the earlier sign is the dominant element as it is the most eye-catching.


Visually, the signs coincide in the verbal element ‘SHAIK’, which is the dominant and distinctive element of the earlier sign.


When signs consist of both verbal and figurative components, in principle, the verbal component of the sign usually has a stronger impact on the consumer than the figurative component. This is because the public does not tend to analyse signs and will more easily refer to the signs in question by their verbal element than by describing their figurative elements (14/07/2005, T‑312/03, Selenium-Ace, EU:T:2005:289, § 37; decisions of 19/12/2011, R 233/2011‑4 Best Tone (fig.) / BETSTONE (fig.), § 24; 13/12/2011, R 53/2011‑5, Jumbo(fig.) / DEVICE OF AN ELEPHANT (fig.), § 59).


Therefore, the signs are similar to an average degree from a visual point.


Aurally, irrespective of the different pronunciation rules in different parts of the relevant territory, the pronunciation of the signs coincides in the sound of the letters ‛SHAIK’, present identically in both signs, in the earlier mark it appears twice. The pronunciation differs in the sound of the letters ‘DESIGNERS’ of the earlier sign, which is the non-distinctive element of the earlier sign.The letter “S” in the contested sign is unlikely to be pronounced as it will be merely seen as part of a very stylised secondary logo within the main mark.


Therefore, the signs are aurally highly similar.



Conceptually, while the public in the relevant territory will perceive the Arabic letters and the non-distinctive verbal element ‘DESIGNER’ in the earlier sign as a reference to the ‘Arabic script or ornamentation and ‘referring to a person who designs’ the other sign lacks any meaning in that territory. Since one of the signs will not be associated with any meaning, the signs are not conceptually similar.


As the signs have been found similar in at least one aspect of the comparison, the examination of likelihood of confusion will proceed.



  1. Distinctiveness of the earlier mark


The distinctiveness of the earlier mark is one of the factors to be taken into account in the global assessment of likelihood of confusion.


The opponent did not explicitly claim that its mark is particularly distinctive by virtue of intensive use or reputation.


Consequently, the assessment of the distinctiveness of the earlier mark will rest on its distinctiveness per se. In the present case, the earlier trade mark as a whole has no meaning for any of the goods and services in question from the perspective of the public in the relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as normal, despite the presence of a non‑distinctive element in the mark as stated above in section c) of this decision.



  1. Global assessment, other arguments and conclusion



The goods and services are partly identical, partly similar (lowly) and partly dissimilar.


The signs are aurally and visually similar to the extent that they both include the word ‘SHAIK’, which is the only verbal element besides the letter ‘S‘ inside a circle on top of the verbal element, in the contested sign and is fully included in the earlier mark in a central and dominant position. It is the dominant and more distinctive element in the earlier mark.


When a sign, such as both marks, consists of both word and figurative components, the word components of the sign usually have a stronger impact on the consumer than the figurative components. This is because the public will more readily refer to a sign by its verbal component than by describing the elements of stylisation.


The aforementioned principle is fully applicable in the present case, since the relevant public will clearly read and pronounce the word ‘SHAIK’ in the contested mark and also in the earlier mark because the word ‘SHAIK’ is also reproduced in the lower part of the mark after the verbal element ‘DESIGNER‘ which lacks distinctiveness. It should be added that the stylisation of both marks is not sufficiently striking to obscure or camouflage the common word element, to which the relevant consumer will readily refer to name the mark.


The overall impression that the two signs will make on the relevant public will be similar. The differences between the marks are considered insufficient to counteract such an impression.


Considering all the above, the Opposition Division finds that there is a likelihood of confusion on the part of the public and therefore the opposition is partly well-founded on the basis of the opponent’s Union trade mark registration.


It follows from the above that the contested trade mark must be rejected for the goods and services found to be identical or similar to those of the earlier trade mark. The same principle also applies to the goods considered to be lowly similar as the fully distinctive verbal element SHAIK is clearly identifiable in both marks.


The rest of the contested goods and services are dissimilar. As similarity of goods and services is a necessary condition for the application of Article 8(1) EUTMR, the opposition based on this article and directed at these goods and services cannot be successful.


For the sake of completeness, it must be mentioned that the opposition must fail insofar as based on grounds under Article 8(1)(a) EUTMR because the signs are obviously not identical.



COSTS


According to Article 85(1) EUTMR, the losing party in opposition proceedings must bear the fees and costs incurred by the other party. According to Article 85(2) EUTMR, where each party succeeds on some heads and fails on others, or if reasons of equity so dictate, the Opposition Division shall decide a different apportionment of costs.


Since the opposition is successful only for part of the contested goods and services, both parties have succeeded on some heads and failed on others. Consequently, each party has to bear its own costs.

According to Article 59 EUTMR, any party adversely affected by this decision has a right to appeal against this decision. According to Article 60 EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. It must be filed in the language of the proceedings in which the decision subject to appeal was taken. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 720 has been paid.
