2. International registration No 1 224 226 is refused protection in respect of the European Union for all of the contested goods. It may proceed for the remaining goods.

3. The holder bears the costs, fixed at EUR 650.

REASONS:

The opponent filed an opposition against some of the goods of international registration designating the European Union No 1 224 226 for the figurative mark , namely against all the goods in Class 5. The opposition is based on the following earlier marks:

Austrian trade mark registration No 78 603 for the word mark ‘FRENTO’;
German trade mark registration No 991 583 for the word mark ‘FRENTO’;
Portuguese trade mark registration No 187 257 for the word mark ‘FRENTO’;
Greek trade mark registration No 83 960 for the word mark ‘FRENTO’;
Italian trade mark registration No 311 497 (No 1 579 561) for the word mark ‘FRENTO’.

The opponent invoked Article 8(1)(b) EUTMR in relation to all of the earlier marks. In addition, the opponent invoked Article 8(5) EUTMR in relation to earlier Austrian trade mark registration No 78 603.

LIKELIHOOD OF CONFUSION – ARTICLE 8(1)(b) EUTMR

A likelihood of confusion exists if there is a risk that the public might believe that the goods or services in question, under the assumption that they bear the marks in question, come from the same undertaking or, as the case may be, from economically linked undertakings. Whether a likelihood of confusion exists depends on the appreciation in a global assessment of several factors, which are interdependent. These factors include the similarity of the signs, the similarity of the goods and services, the distinctiveness of the earlier mark, the distinctive and dominant elements of the conflicting signs and the relevant public.

The opposition is based on more than one earlier trade mark. The Opposition Division finds it appropriate to first examine the opposition in relation to the opponent’s Austrian trade mark registration No 78 603.

In comparison to the opponent’s first aid kits, the contested goods in this group are identical (either because they are identically contained in both lists, including synonyms, such as filled first aid kits; first-aid boxes, filled; first aid boxes sold filled; first-aid kits, or because the opponent’s goods include the contested goods as a broader category, such as portable first-aid kits).

Conclusion on the comparison of goods

It follows that all of the contested goods are identical or at least similar to the opponent’s goods.

Relevant public — degree of attention

The average consumer of the category of products concerned is deemed to be reasonably well informed and reasonably observant and circumspect. It should also be borne in mind that the average consumer’s degree of attention is likely to vary according to the category of goods or services in question.

In the present case, the relevant goods are directed at the public at large and at business customers with specific professional knowledge or expertise in the fields of healthcare, veterinary medicine, pharmaceutical industry, or pest control.

It is apparent from the case-law that, insofar as pharmaceutical preparations are concerned, the relevant public’s degree of attention is relatively high, whether or not issued on prescription (15/12/2010, T-331/09, Tolposan, EU:T:2010:520, § 26; 15/03/2012, T-288/08, Zydus, EU:T:2012:124, § 36 and cited case-law). In particular, medical professionals have a high degree of attentiveness when prescribing medicines. Non-professionals also have a higher degree of attention, regardless of whether the pharmaceuticals are sold without prescription, as these goods affect their state of health.

In addition, the impact on safety of goods covered by a trade mark (such as poisonous substances for vermin extermination) may result in an increase in the relevant consumer’s degree of attention.

All in all, the degree of attention may vary from average to high, depending on the specialised nature of the goods, their impact on the consumer’s health, the frequency of purchase and their price.

The signs

The relevant territory is Austria.

The global appreciation of the visual, aural or conceptual similarity of the marks in question must be based on the overall impression given by the marks, bearing in mind, in particular, their distinctive and dominant components (11/11/1997, C-251/95, Sabèl, EU:C:1997:528, § 23).

The earlier mark consists of the word ‘FRENTO’. The contested sign comprises the word ‘FRENATO’ in slightly stylised typeface (white letters with black double-borders in title case). Neither of these words has any meaning in German. They will be perceived as fanciful terms for the goods at issue, having an average degree of inherent distinctiveness.

The contested sign’s verbal element is depicted within a figurative device, consisting in basic shapes, namely two curved lines, a black rectangle marking the bottom side of the sign and a large rectangle encompassing all of the foregoing. Given the merely decorative nature and commonplace character of curvilinear shapes and rectangles on product packaging on the relevant market, it is considered that they have almost no capacity to indicate commercial origin. Although the specific arrangement of these individual shapes is arbitrary, the distinctiveness of the contested sign’s figurative elements is weak.

Moreover, it has to be borne in mind that, when signs consist of both verbal and figurative components, in principle, the verbal component of the sign usually has a stronger impact on the consumer than the figurative component. This is because the public does not tend to analyse signs and will more easily refer to the signs in question by their verbal element than by describing their figurative elements (14/07/2005, T-312/03, Selenium-Ace, EU:T:2005:289, § 37).

Visually, the signs coincide in the letters ‘FREN*TO’ which constitute the entirety of the earlier mark and appear, in the same order, in the contested sign’s most distinctive element, ‘FRENATO’, albeit in a slightly stylised depiction. In addition to this, the contested sign differs in that it contains an additional letter, ‘A’, in the middle of the shared six-letter sequence, and the weak figurative elements. Therefore, the signs are highly similar.

Aurally, the pronunciations of the signs coincide in the sound of the letters ‛FREN*TO’, present identically in both signs. Since the figurative elements of the contested sign will not be referred to aurally, the pronunciation of the contested sign only differs in the vowel ‘A’ in the middle of the shared six-phoneme sequence. Therefore, the signs are highly similar.

Conceptually, neither of the signs has a meaning for the public in the relevant territory. As regards the figurative elements of the contested sign, they will not be associated with any relevant semantic content. Since a conceptual comparison is not possible, the conceptual aspect does not influence the assessment of the similarity of the signs.

As the signs have been found similar in at least one aspect of the comparison, the examination of likelihood of confusion will proceed.

Distinctiveness of the earlier mark

The distinctiveness of the earlier mark is one of the factors to be taken into account in the global assessment of likelihood of confusion.

According to the opponent, the earlier mark has been extensively used and enjoys an enhanced scope of protection in relation to veterinary preparations and health care products; pesticides, insecticides, larvicides, preparations for the prevention of insect and bird damage; insecticidal collars, bands and medallions; soaps, bath additives and bath supplements for animals in Class 5. However, for reasons of procedural economy, the evidence filed by the opponent to prove this claim does not have to be assessed in the present case (see below in ‘Global assessment’).

Consequently, the assessment of the distinctiveness of the earlier mark will rest on its distinctiveness per se. In the present case, the earlier trade mark has no meaning for any of the goods in question from the perspective of the public in the relevant territory. Therefore, the distinctiveness of the earlier mark must be seen as normal.

Global assessment, other arguments and conclusion

The contested goods are identical or at least similar to the opponent’s goods. The signs show striking similarities, both visually and aurally, on account of the fact that the contested sign comprises a verbal element that differs from the sole element of the earlier mark in one letter/sound appearing in a rather inconspicuous position. That difference, being conceptually neutral, can go unnoticed by the average consumer, whether the general public or professionals.

Account is taken of the fact that average consumers rarely have the chance to make a direct comparison between different marks, but must trust in their imperfect recollection of them (22/06/1999, C-342/97, Lloyd Schuhfabrik, EU:C:1999:323, § 26). Even consumers who pay a high degree of attention need to rely on their imperfect recollection of trade marks (21/11/2013, T-443/12, ancotel, EU:T:2013:605, § 54).

As explained in section c) of this decision, the figurative element of the contested sign has a very limited impact on its overall impression. Moreover, it has to be pointed out that it is common practice, on the relevant market, for manufacturers to make variations of their trade marks, for example by altering the typeface or colours, or adding verbal or figurative elements to them, in order to denote new product lines, or to endow their trade mark with a new image. Therefore, consumers are well accustomed to word marks being stylised and depicted in logotypes.

In an overall assessment of the relevant factors of the case, and based on the average degree of inherent distinctiveness of the earlier mark, it is concluded that the differences identified between the signs are clearly insufficient for enabling the relevant public to safely distinguish between the signs, even where the degree of attention is enhanced.

Considering all the above, there is a likelihood of confusion on the part of the public.

Therefore, the opposition is well founded on the basis of the opponent’s Austrian trade mark registration No 78 603. It follows that the contested trade mark must be rejected for all the contested goods.

Since the opposition is successful on the basis of the inherent distinctiveness of the earlier mark, there is no need to assess the enhanced degree of distinctiveness of the opposing mark due to its reputation as claimed by the opponent. The result would be the same even if the earlier mark enjoyed an enhanced degree of distinctiveness.

As earlier Austrian trade mark registration No 78 603 leads to the success of the opposition and to the rejection of the contested trade mark for all the goods against which the opposition was directed, there is no need to examine the other earlier rights invoked by the opponent (16/09/2004, T-342/02, Moser Grupo Media, S.L., EU:T:2004:268).

Since the opposition is fully successful on the basis of the ground of Article 8(1)(b) EUTMR, there is no need to further examine the other ground of the opposition, namely Article 8(5) EUTMR.

COSTS

According to Article 85(1) EUTMR, the losing party in opposition proceedings must bear the fees and costs incurred by the other party.

Since the holder is the losing party, it must bear the opposition fee as well as the costs incurred by the opponent in the course of these proceedings.

According to Rule 94(3) and (6) and Rule 94(7)(d)(i) EUTMIR, the costs to be paid to the opponent are the opposition fee and the costs of representation which are to be fixed on the basis of the maximum rate set therein.

According to Article 59 EUTMR, any party adversely affected by this decision has a right to appeal against this decision. According to Article 60 EUTMR, notice of appeal must be filed in writing at the Office within two months of the date of notification of this decision. It must be filed in the language of the proceedings in which the decision subject to appeal was taken. Furthermore, a written statement of the grounds of appeal must be filed within four months of the same date. The notice of appeal will be deemed to be filed only when the appeal fee of EUR 720 has been paid.

The amount determined in the fixation of the costs may only be reviewed by a decision of the Opposition Division on request. According to Rule 94(4) EUTMIR, such a request must be filed within one month from the date of notification of this fixation of costs and will be deemed to be filed only when the review fee of EUR 100 (Annex I A(33) EUTMR) has been paid.
